ShutterID Terms of Service

§ 1. Who runs the service

The ShutterID service, available at shutterid.com, studio.shutterid.com and library.shutterid.com, is run by Damian Dąbrowski ECHOTXMX, ul. Zielona 38/18, 12-220 Ruciane-Nida, Poland, VAT ID (NIP) 5272407037, REGON 141643088 (the "Provider"). Contact: damian@echotxmx.com.

§ 2. What ShutterID does

ShutterID is for private photo delivery: a photographer (the "Photographer") places photos and videos in the service and then shares them with people of their choosing (the "Recipient") — by a private link, by an e-mail invitation tied to the Recipient's account, or both. The service includes, among other things, the Photographer's panel (Studio), the Recipient's library, the ShutterID mobile app, the Adobe Lightroom Classic plug-in, watermarks, licenses, photo approvals, and e-mail and push notifications.

The service is provided as a beta. This means features may change and availability may be interrupted by development work.

§ 3. Accounts and access

A Photographer's account is created by the Provider. The Photographer is responsible for keeping sign-in data and Lightroom plug-in tokens confidential.
A Recipient uses the service through a private link received from the Photographer or through an account created with an external sign-in (currently Google in the browser and Apple in the mobile app). The link works like a key — the Recipient should not pass it on.
An e-mail invitation is single-use: once pinned to the Recipient's account, the access belongs to that account. The address the invitation was sent to need not be the address of the account the Recipient signs in with.
The Photographer may revoke a link, an invitation or an account's access at any time — without giving a reason.

§ 4. Content and copyright

Photos and videos placed in the service remain the property of the Photographer or of those who hold rights to them. The Provider acquires no rights to them beyond what is technically necessary to provide the service (storage, generating thumbnails and watermarks, transmission).
The Photographer declares that they have the right to upload and share the submitted materials, including — where they depict people — that they have an appropriate basis for distributing them.
The extent to which a Recipient may use the received materials is set by the Photographer (e.g. in the license visible in the library).
Posting unlawful content is prohibited. Anyone may report such content with the report button next to a photo or at the contact address; reports are handled by the Photographer and the Provider.

§ 5. Rules of use

In particular, the following is not allowed:

attempts to circumvent protections, including guessing links,
disrupting the service (e.g. automated mass requests),
impersonating others when introducing yourself in a library or in comments,
posting unlawful or offensive content in comments.

§ 6. Liability

The Provider strives to keep the service running continuously and securely, but during the beta does not guarantee any particular level of availability.
The service is not the sole place materials are stored — the Photographer should keep their own copies of the originals.
The Provider is not responsible for content posted by Photographers and Recipients, nor for arrangements between them (e.g. license scope, payments).
The Provider's liability towards businesses is limited to cases of willful misconduct. Towards consumers, liability is governed by generally applicable law.

§ 7. Fees

During the beta, use of the service is free of charge unless the Photographer and the Provider agree otherwise. Photographers will be informed in advance before any pricing is introduced.

§ 8. Complaints and ending use

Complaints may be sent to damian@echotxmx.com; a reply within 14 days.
The Photographer may stop using the service at any time by requesting deletion of the account and materials. A Recipient may delete their account themselves in the mobile app ("Close my account") or by writing to the contact address.
The Provider may block an account that violates these Terms, after a demand to cease the violations — and in flagrant cases, without one.

§ 9. Changes to the Terms and governing law

The Provider announces changes to these Terms on this page, and additionally notifies Photographers by e-mail, at least 14 days in advance, unless the change follows from the law. The governing law is Polish law. How personal data is processed is described in the Privacy Policy.
